Почему бы тогда не передать ненужное вам оборудование сторонней компании? Подобная двойная передача предмета лизинга абсолютно законна и носит название сублизинг.
Сублизинг является разновидностью поднайма предмета лизинга и уже давно широко используется во всём мире. От обычного лизинга он отличается тем, что в этом случае лизингополучатель, руководствуясь договором лизинга, передаёт сторонним лицам (лизингополучатели по договору сублизинга) во временное пользование и за соответствующую плату имущество, которое было ранее получено у лизингодателя по договору лизинга как предмет лизинга. Об этом можно узнать, изучив статью №8 "Закона о лизинге". Говоря проще, сублизинг является законной предпринимательской деятельностью, позволяющей компании снизить затраты на неиспользуемое оборудование, купленное в лизинг.
Сдача предмета лизинга в сублизинг предполагает переход к субарендатору всех прав относительно продавца. Кроме того, оформление сублизинга должно осуществляться только после получения письменного согласия лизингодателя. Стоит, правда, помнить о том, что сублизингополучатель получает права только на пользование и владение имуществом, но не имеет никаких прав на распоряжение им. Права на распоряжение имуществом остаются у лизингодателя. От обычной же субаренды сублизинг, прежде всего, отличается тем, что при передаче имущества по сублизинговой схеме к сублизингополучателю переходит и право требования к продавцу. С другой стороны, согласно российскому закону о лизинге, переуступка лизингополучателем обязательств по выплате лизинговых платежей сторонним лицам не допускается.
