Правовое регулирование лизинга в Российской Федерации

Что такое лизинг?
Лизинг представляет собой совокупность правовых и экономических отношений, которые возникают в ходе выполнения обязательств по договору лизинга, в том числе и покупка предмета лизинга. Об этом говорится в федеральном законе Российской Федерации, который носит название "О финансовой аренде (лизинге)". Стоит отметить, что определение лизинга, с которым можно ознакомиться в приведенном законе, позволяет по-разному трактовать это понятие в правовом аспекте, что иногда приводит к различным юридическим коллизиям.
Договор лизинга (договор финансовой аренды).
Договор лизинга – это правовой документ, согласно которому арендодатель обязуется приобрести в личную собственность имущество, указанное арендатором. Имущество приобретается у указанного арендатором продавца, а также предоставляется ему за соответствующую плату во временное владение и использование для получения прибыли. Иными словами, предмет лизинга (имущество) может применяться арендатором в предпринимательских целях. В данном случае арендодатель не несёт никакой ответственности за выбранный арендатором предмет лизинга и продавца, у которого покупается то или иное имущество. С другой стороны, договор лизинга предусматривает, что выбор продавца и покупаемого имущества может осуществляться арендодателем. Более подробную информацию о договоре лизинга можно получить, ознакомившись со статьёй 665 гражданского кодекса Российской Федерации "Договор финансовой аренды".
Предмет лизинга.
В качестве предмета лизинга может быть использовано абсолютно любое непотребляемое имущество, которое подходит для осуществления предпринимательской деятельности. К подобному имуществу относятся предприятия, недвижимость, различные промышленные комплексы, жилые и нежилые постройки, заводское оборудование, автомобили, сельскохозяйственная техника и пр. Необходимо, однако, помнить, что предметом лизинга не могут быть земельные участки, разнообразные природные объекты и имущество, запрещённое государственными органами к свободному обращению или обращению в особом порядке.
